One Crown, Four Fates

A Comparative Analysis of Land Value Capture in Canada, Australia, New Zealand, the United Kingdom, and the United States

Canada, Australia, New Zealand, the United Kingdom, and the United States — five nations with shared institutional roots, yet radically different mechanisms for capturing and returning land value to citizens.

"They share the same Crown. But they do not share the same fate."

1. Land Value Capture Score

This analysis focuses on Parameter 9 of the GL Framework: Land Value Capture & Closure — the mechanism by which land value generated by public investment is recovered and reinvested in public services.

Country Land Value Capture Score Grade Core Diagnosis
Canada 54 Weak Capture Crown land dominant, no aristocracy, but capital is seeping in
Australia 52 Weak Capture Institutions sound, mining capital powerful, land value return mechanism needs scrutiny
New Zealand 58 Weak Capture Governance good, Māori land complex, foreign capital buying land a concern
United Kingdom 40 No Capture 70% land in aristocratic hands, two parties rotate, landlord never changes
United States 35 No Capture Financial capital as landlord — land value captured by Wall Street, not citizens

The widest gap is in Land Value Capture: Canada 54, UK 40, US 35. In the UK, value is filtered by aristocracy. In the US, by financial capital. In Canada, Crown land remains structurally protective, but the capture mechanism is weak.

2. What Created the Divergence?

The United Kingdom: The Aristocratic Filter

70% of land in aristocratic hands. Hereditary seats in the House of Lords. Two parties rotate, but neither touches the land structure. Land value is filtered by aristocracy, developers, and financial capital. Result: Land Value Capture score of 40 — effectively no capture.

Canada, Australia, New Zealand: The Crown Land Alternative

No hereditary aristocracy. Land held primarily as Crown land, managed by government. Full Torrens land registration system, with state guarantee of title. Result: Land Value Capture scores of 52–58 — weak capture but structural protection remains.

3. The Torrens System Difference

Dimension UK Canada / Australia / NZ US
Land Registration Modified Torrens, overriding interests Full Torrens, state guarantees title No national system, state-by-state
Transaction Costs High (lawyer-driven) Low (government-driven) High (title insurance-driven)
Title Certainty Incomplete Complete Incomplete (title insurance compensates)
State Role Passive registrar Active guarantor Private insurance system

The Torrens system is not a technical detail — it is a governance choice. It says: the state will make land rights clear, certain, and accessible. Citizens should not need a lawyer to know whether they truly own their home.

4. The United States: Capital as Landlord

The United States has no aristocratic landlords. But its Land Value Capture score of 35 shows clearly: financial capital has replaced the aristocracy as the landlord.

Between 2005 and 2025, institutional holdings of U.S. farmland more than tripled. Market value grew from under $2 billion to over $16 billion. Farmland prices nearly doubled. A January 2026 Yale Law Journal study found this is not "market evolution" — it is a deep social choice embedded in property law, corporate law, and securities law.

In April 2026, the U.S. Congress introduced the Farmland for Farmers Act. Its core logic aligns precisely with the GL Framework's Land Value Capture parameter: farmland is a "limited and critical resource" and a "source of wealth, including intergenerational wealth." The Act explicitly notes that corporate owners prioritize short-term profits over long-term land stewardship and have less interest in what is best for local communities. Crucially, "actively engaged in farming" does NOT include "providing capital alone" — a direct rejection of financialisation.

However: the Act remains in legislation. It has not become law. And it applies only to agricultural land — residential, commercial, and industrial land remains open to financial capital.

The World Justice Project's 2025 Rule of Law Index ranks the U.S. 27th globally, with a score of 0.6820th out of 31 in North America and Europe:

Dimension Score Diagnosis
Constraints on Government Powers0.63Weak
Fundamental Rights0.65Weak
Civil Justice0.62Weak
Criminal Justice0.58Weakest

The Berggruen Governance Index found the U.S. is the only Western power where governance quality has declined in the past 20 years — not "stalled," but regressed.

In 2025, the U.S. federal government shut down for 43 days, a record. 730,000 federal employees were forced to work without pay, 670,000 were furloughed, and food assistance for 42 million people was cut — while congressional salaries continued. In May 2026, during military decision-making on Iran, Congress could not constrain the President, the Cabinet could not correct errors, and the Supreme Court defaulted to executive expansion. The separation of powers has shifted from "deliberation" to "hostage-taking."

The Lesson

No aristocracy does not mean safety.

The US proves that capital is a more efficient landlord than aristocracy. It took aristocrats centuries to monopolise 70% of land; capital tripled farmland holdings in just 20 years.

For Canada, Australia, New Zealand:

You have Crown land — the US does not. You have the Torrens system — the US does not. These are structural protections the US lacks. But they are not permanent. If you do not defend the principle that land value must return to citizens, not capital, capital will do what capital does — faster than any aristocracy.

5. Risks for the Three "Still OK" Nations

Canada — Real estate developers are seeping into land value. If lost, heading toward the UK.

Australia — Mining capital is capturing resource value. If lost, heading toward the UK.

New Zealand — Foreign capital is buying land. If lost, heading toward the UK.

6. The Ethical Premise of Land Value Capture

Capital must not be allowed to supersede government.

Capital is a tool. Government is the arbiter. Citizens are the purpose. When the order is reversed, governance collapses.

7. Conclusion: The Tenant's Choice

Land Value Capture does not predict the future. It diagnoses the present.

Your direction is still your choice.

Four Commonwealth nations share a King. They share a constitutional tradition. They share a language and a history. But they do not share a fate.

The UK has already crossed the threshold into land value capture failure. Canada, Australia, and New Zealand have not yet reached that point. You have structural protections the UK lacks: Crown land, not aristocratic estates; the Torrens system, not legal complexity. The US shows what happens when capital — not aristocracy — becomes the landlord.

The question is not whether you are better than the UK today. The question is whether you will defend the structural differences that make you better — or allow them to erode until you become the UK in a generation.

40
Reino Unido · Sin Captura
35
Estados Unidos · Sin Captura
